The Administrative Court decision in Mason v DPP on whether starting to open a car door was an attempt to drive the car, or merely a preparatory act, for the purposes of driving whilst over the prescribed limit. Notes that although the defendant had the requisite mens rea, admitting he had intended to drive, there was not sufficient actus reus to constitute guilt.
